AB150-ASA, s. 7153 Section 7153. 814.61 (3) (a) of the statutes is repealed.

AB150-ASA, s. 7154 Section 7154. 814.61 (3) (b) of the statutes is renumbered 814.61 (3) and amended to read:

AB150-ASA,2205,18 814.61 (3) Third-party complaint. Beginning with the fees imposed on September 1, 1989, and ending with fees imposed on December 31, 1995, when When any defendant files a 3rd-party complaint, the defendant shall pay a fee of $45. The defendant shall pay only one such $45 fee in an action. Of the fees received by the clerk under this paragraph subsection, the county treasurer shall pay $25 to the state treasurer for deposit in the general fund and shall retain the balance for the use of the county. The state treasurer shall credit $5 of the $25 to the appropriation under s. 20.680 (2) (j).

AB150-ASA, s. 7154e Section 7154e. 814.61 (3) of the statutes, as affected by 1995 Wisconsin Act .... (this act), is amended to read:

No fee may be collected under this paragraph for any petition or motion by either party for the revision of a judgment or order involving child support, family support or maintenance if both parties have stipulated to the revision of the judgment or order. Of the fees received by the clerk under this paragraph, the county treasurer shall pay 50% to the state treasurer for deposit in the general fund and shall retain the balance for the use of the county.

AB150-ASA, s. 7162 Section 7162. 814.61 (10) (b) of the statutes is created to read:

AB150-ASA,2208,7 814.61 (10) (b) For copies of any court document requested by the state public defender, other than a transcript, a fee equal to the actual, necessary and direct costs of copying.

AB150-ASA, s. 7163 Section 7163. 814.61 (13) of the statutes is amended to read:

AB150-ASA,2208,14 814.61 (13) Support or maintenance petition. For the cost to the county of administering s. 46.25 of court services, whenever a person not receiving aid under s. 49.19, 49.46, 49.465, 49.468 or 49.47 files a petition requesting child support, maintenance or family support payments, $10 in addition to any other fee required under this section. This subsection does not apply to a petition filed by the state or its delegate.

AB150-ASA, s. 7163m Section 7163m. 814.62 (1) of the statutes, as affected by 1995 Wisconsin Act .... (this act), is amended to read:

AB150-ASA,2208,22 814.62 (1) Garnishment actions. The fee for commencing a garnishment action under ch. 812, including actions under s. 799.01 (1) (d) 2., is $20. Of the fees received by the clerk under this subsection, the county treasurer shall pay $12.50 to the state treasurer secretary of administration for deposit in the general fund and shall retain the balance for the use of the county. The state treasurer secretary of administration shall credit $5 of the $12.50 to the appropriation under s. 20.680 (2) (j).

(a) 2., the county treasurer shall pay $11.80 to the state treasurer for deposit in the general fund and shall retain the balance for the use of the county. The state treasurer shall credit the $11.80 to the appropriation under s. 20.680 (2) (j).

AB150-ASA,2210,25 814.63 (1) (b) Beginning with the fees imposed on September 1, 1989, and ending with the fees imposed on December 31, 1995, in In all forfeiture actions in circuit court, the clerk of court shall collect a fee of $20 to be paid by the defendant when judgment is entered against the defendant.

AB150-ASA,2211,17 814.634 (1) (a) Except for an action for a safety belt use violation under s. 347.48 (2m), the clerk of circuit court shall charge and collect a $20 $40 court support services fee from any person, including any governmental unit as defined in s. 108.02 (17), paying a fee under s. 814.61 (1) (a), (3) or (8) (a) or (am) , 814.62 (1), (2) or (3) (a) or (b) or 814.63 (1). The court support services fee is in addition to the other fees listed in this subsection.

AB150-ASA, s. 7175f Section 7175f. 814.634 (1) (b) of the statutes is created to read:

AB150-ASA,2211,23 814.634 (1) (b) Notwithstanding par. (a), the clerk of circuit court shall charge and collect a $100 court support services fee from any person, including any governmental unit as defined in s. 108.02 (17), paying a fee under s. 814.61 (1) (a) or (3) or 814.62 (1) or (2), if the party paying the fee seeks the recovery of money and the amount claimed exceeds the amount under s. 799.01 (1) (d).

AB150-ASA, s. 7175h Section 7175h. 814.634 (1) (c) of the statutes is created to read:

AB150-ASA,2212,6 814.634 (1) (c) Notwithstanding par. (a), the clerk of circuit court shall charge and collect a $30 court support services fee from any person, including any governmental unit as defined in s. 108.02 (17), paying a fee under s. 814.62 (3) (a) or (b), or paying a fee under s. 814.61 (1) (a) or (3) or 814.62 (1) or (2) if the party paying the fee seeks the recovery of money and the amount claimed is equal to or less than the amount under s. 799.01 (1) (d).

AB150-ASA, s. 7177 Section 7177. 814.635 (1) of the statutes is amended to read:

AB150-ASA,2212,22 814.635 (1) Except for an action for a safety belt use violation under s. 347.48 (2m), the clerk of circuit court shall charge and collect a $3 court automation $5 justice information system fee from any person, including any governmental unit as defined in s. 108.02 (17), paying a fee under s. 814.61 (1) (a), (3) or (8) (a) or (am), 814.62 (1), (2) or (3) (a) or (b) or 814.63 (1). The court automation justice information system fee is in addition to the other fees listed in this subsection.

AB150-ASA, s. 7177g Section 7177g. 814.635 (2) of the statutes is amended to read:

AB150-ASA,2213,3 814.635 (2) The clerk shall pay the moneys collected under sub. (1) to the county treasurer under s. 59.395 (5). The county treasurer shall pay those moneys to the state treasurer secretary of administration under s. 59.20 (11).

AB150-ASA, s. 7177r Section 7177r. 814.65 (1) of the statutes is amended to read:

AB150-ASA,2213,12 814.65 (1) Court costs. In a municipal court action, except an action for violation of an ordinance in conformity with s. 347.48 (2m), the municipal judge shall collect a fee of $15 on each separate matter, whether it is on default of appearance, a plea of guilty or no contest, on issuance of a warrant or summons or the action is tried as a contested matter. Of each $15 fee received by the judge under this subsection, the municipal treasurer shall pay monthly one-third to the state treasurer secretary of administration for deposit in the general fund and shall retain the balance for the use of the municipality.

AB150-ASA, s. 7179m Section 7179m. 814.66 (3) of the statutes is amended to read:

AB150-ASA,2214,7 814.66 (3) The register in probate shall, on the first Monday of each month, pay into the office of the county treasurer all fees collected by him or her and in his or her hands and still unclaimed as of that day. Each county treasurer shall make a report under oath to the state treasurer secretary of administration on or before the 5th day of January, April, July and October of all fees received by him or her under sub. (1) (a) to (f) up to the first day of each of those months and shall at the same time pay 50% of the fees to the state treasurer secretary of administration for deposit in the general fund. Each county treasurer shall retain the balance of fees received by him or her under this section for the use of the county.

AB150-ASA, s. 7180 Section 7180. 814.67 (1) (bg) of the statutes is created to read:

AB150-ASA,2214,10 814.67 (1) (bg) For interpreters assisting the state public defender in representing an indigent in preparing for court proceedings, $35 per one-half day.

AB150-ASA, s. 7181 Section 7181. 814.69 of the statutes is renumbered 814.69 (1) and 814.69 (1) (b), as renumbered, is amended to read:

AB150-ASA,2214,17 814.69 (1) (b) For a transcript under s. 757.57 (5), a fee from the party requesting the transcript at the rate of $1.75 per 25-line page for the original and 60 cents per 25-line page for each copy. If the request is by the state or any political subdivision thereof, the fees of the reporter shall be at the rates provided in sub. (1) par. (a).

AB150-ASA,2214,21 814.69 (2) Any fees collected by a court reporter whose court reporter equipment is purchased by the state under s. 758.19 (4m) shall be deposited in the state treasury and credited to the general fund.
